Sorry, bad formulation. The intended meaning was: we have found two  
bugs, this is one of them. We have not been able to solve any of them.

The bugs have been reported here on the list, and in the issue  
tracker. See:

duplicate of FOR-435)

The other bug (wrong rendering of UTF-8 input) is actually more  
serious than the present one, as it renders the output unreadable,  
whereas most browsers will render the incorrectly nested lists just  
fine - it is just if you want to reuse the generated xml that the  
list parsing error is a problem.
