Kelvin Goodson resolved TUSCANY-1099.

    Resolution: Fixed

Patch tested on IBM JDK 1.4.2 windows and linux.  Both runs now compile after this fix.  One test failure ensues,  but not related to this fix,  hence I have raised TUSCANY-1122
