This should happen with dynamic class loading or via an interface, as discussed here:

Could be as simple as storing a factory in application scope at startup.

That's not true any more. In fact, it would never make it out of
incubation if it still had LGPL anything. Those have all been
removed or replaced.

regarding your licensing issue, there is a 3rd party licensing policy
*draft* from Cliff.
Also there is a legal-discuss list <at> apache.
I read on struts list (or legal discuss) that WebWork, which is in
incubation, depends on LGPL stuff (js files)
