The test case this SPR was written for no longer fails. The files are
below.
     XSLT
     <?xml version="1.0"?>
     <xsl:stylesheet xmlns:xsl="http://www.w3.org/1999/XSL/Transform"
     version="1.0">
     <xsl:template match="doc">
       <out>
         <xsl:value-of select="name"/>
       </out>
     </xsl:template>
     </xsl:stylesheet>

     XML
     <?xml version="1.0"?>
     <doc>
     <name>Levi Strauss &amp; Co.</name>
     </doc>

I did see a note with the closed spr that stated that this problem was
xerces dependent,  however,  I'm not sure what level of it is required.

If you are still seeing this as a problem please send to me, directly, a
simplified example of the failure.
