I would say that that's a separate issue and discussion. That question isn't answered in the current policy and the change proposed here (essentially: "current and past versions" vs. "this version") doesn't depend on (or affect) how we define a "version".

Good link Ralph. It seems to justify the current method we have very nicely, namely get the oldest date in there, range up to the latest date but if you're going to be in error, be in error on the latest date.

I looked some more. Please see http://www.copyright.gov/circs/circ03.pdf and http://www.copyright.gov/circs/circ14.pdf. Although the current practice seems to be widely followed it is wrong. It gives the impression that somehow the copyright is extended by additional work where the new copyright date would only extend to the additional enhancements, providing they are substantial enough to warrant it.

Here's an updated version of the patch that also updates the example NOTICE file to be the current NOTICE from httpd. I dropped the extra comment and indenting from the example file, as AFAIK there have been cases of projects including such extra stuff in their NOTICE files based on the format of the example.

I don't feel too strongly about this, just trying to mind the details. As discussed on legal-discuss@, the "correct" (if one can say so) approach is for the copyright year to reflect *this version* of the product, not necessarily *current and past versions*.
I don't mind projects keeping their current practices as AFAIUI there's nothing really wrong about that, but it bugs me that our documentation recommends something that's not the best practice. At least it would be good to should say that including the years of past versions is not really necessary.

My only concern here is that it links in with conversation about registering copyright of each version. What we consider a version to be might have financial repercussions.
ie) Can Tomcat 3.x all be one copyright set, then Tomcat 4.x is the next one?

We'd need further questions on what a version is. For example, if we consider every code change a version we would have the following:
* If I make a bugfix, do I modify the copyright?

* If I repackage the original version, do I modify the copyright?

I'm still not seeing a need to change things at Apache.
It's possible that a release could be made in which the work in the new year was not substantial enough to warrant a copyright date; but a) I don't think the release manager is in a position to make that statement and b) I think the number of times the change in the new year would not be copyrightable is far outweighed by the number of times it would be.
In terms of giving the impression that copyright is extended when it's only the new copyright... I think of a 2nd edition of a book. It updates the copyright year but doesn't give you a line by line or chapter by chapter breakdown of which copyright relates to which.

5 months later I'm uncomfortable with changing this without looping back on the subject on the list and possibly getting legal-internal confirmation of the output. The current practice is such a standard within our industry that I don't want to veer from it unduly, and I'm not seeing a strong value in changing the practice.
