Reading the OP's comments, the issue is, AFAICT, the same as described in bug 38346.

Having tested the latest code extensively I can recreate the conditions
described in this bug but Tomcat always behaves correctly. I am taking this as
sufficient evidence that the root cause of this issue is the same as that in 38346.
