I saw this in 10.8  windows:
http://people.apache.org/~myrnavl/derby_test_results/v10_8/windows/testlog/ibm142/1239450-suites.All_diff.txt.  Dag recommends  not backporting the DERBY-3823 fix, so it may come up from time to time.
