    Resolution: Invalid

See section 3.3.1 [1] of Part 1: Structures which says "Element declarations for which {abstract} is true can appear in content models only when substitution is allowed; such declarations may not themselves ever be used to ·validate· element content". It may be true that you cannot construct a valid instance document for this schema, but the schema itself is valid.
