(a) MS WORD 2010 seems to have a trick so that empty Heading will not be shown
in TOC:
(a1) Open document wiht MSWORD, delete all text from heading 
     "Heading 1 What is a table of contents" so that only empty line stays.
    After Update of TOC the TOC item will have vanished
(a2) Type some blanks into former Heading line
     After update of TOC no item for heading reappears
(a3) Type a dot (or an other  single character)  into former heading line
     fater update of TOC item for heading reappears

(b) The WSWORD trick might be something useful for careless users who forget
    to remove empty heading lines or whatever else
(c) But IMHO it is nonsense not to show a heading what user has inserted 
    intendedly, even if Heading has no text or only blanks. Currently I
consider
    WORD behavior a bug
(d) How can we "fix" that? For the sake of identical TOC appearance we can
(d1) not show empty Headings. But what if AOO users consciously use current
     AOO behavior as intended style element for their texts? Old documents
     would change view in new AOO, not a good Idea. Additionally that might
     not be in accordance with ODF definidions.
(d2) Changing paragraph style during import to something what normally does not
     appear in TOC. But what if document will return as .doc to author using
     MSWORD? He will find document more or less destroyed, who can know for 
     what reason he might have had to insert that blank heading?
(d3) We can add import options how to handle empty Headings. But is it 
     that worth? Is that really an interesting problem or only relevant for
     3 documents in entire universe? I think there are more important issues
(e) Due to (d) I currently do not think that we need a fix here, as long
    as no additional good reasons for a fix have been contributed. I will
    close this one NOT_AN_ISSUE in February 2014 if no additional reasons 
    will have been found for a fix
(f)  Already reproducible with  Pre-3.4.0 (OOo 1.1.5), but because of crippled  
     Version selector (Bug 123063) no useful info can be contributed
(g) Latest confirmation for AOO 4.1.0-dev, but because of incomplete LCo 
    selector (Bug 123063) no correct information can be contributed.
(h) OS = ALL due to my results
