[jira] [Commented] (LEGAL-639) Blue Oak Model License 1.0.0

    [ https://issues.apache.org/jira/browse/LEGAL-639?page=com.atlassian.jira.plugin.system.issuetabpanels:comment-tabpanel&focusedCommentId=17707725#comment-17707725 ]

Henri Yandell commented on LEGAL-639:
-------------------------------------

The patent contributor part gets interesting imo, but I don't think that stops us from considering it as category A. It just means that we may find users querying us on the use of the license because it causes them contribution concern.

Apache-2.0, and other licenses, describes patent contributing as:
{noformat}
"where such license applies only to those patent claims licensable by such Contributor that are necessarily infringed by their Contribution(s) alone or by combination of their Contribution(s) with the Work to which such Contribution(s) was submitted"{noformat}
We then worked on a FAQ to explain a reasonable (we felt) line on patent licensing: https://www.apache.org/foundation/license-faq.html#PatentScope

Blue Oak license is more aggressive/activist, going with:
{noformat}
"do everything with this software that would otherwise infringe any patent claims they can license or become able to license"{noformat}
That feels unreasonable in its simplicity, but it's I don't see it as a concern for us.

So; I'm +1 to add it to Category A.

> At Apache Cordova, we have came into a situation that one of our dependencies now imports a module licensed under Blue Oak Model License 1.0.0.
> The license text can be found at: [https://blueoakcouncil.org/license/1.0.0]
> Based on our non-legal/non-lawyer analysis, the license appears to be acceptable for Category A of the [ASF 3rd Party License Policy |https://www.apache.org/legal/resolved.html#category-a]
> We would like confirmation if the Blue Oak Model License 1.0.0 is okay to be included in Apache projects, and if so, should it be added to the License Policy list?
> Thank you for your time.
