The timestamps are supposed to be set on the mod_ssl ssl_expr_* files to avoid
make regenerating them (see buildconf), and indeed, I haven't seen make do that
in a long time.  Can you investigate further exactly why they are getting
regenerated for you?

Patches would be definitely welcome to adjust the install* targets to use
$(INSTALL) rather than cp -p.
