[jira] [Closed] (LEGAL-473) Need suggestions about including a simplified BSD project source code to Apache Project

Henri Yandell closed LEGAL-473.
-------------------------------
    Resolution: Fixed

You can include TonY under the BSD-2 license; it's listed as a Category A license. The best practice is to keep that distinct from your project's source code so it's clear to your users which license applies to which. If you need to make small changes to TonY then it is fine to do so under the BSD-2 license, but if the modified version becomes a core part of your project's development activities then you should think about using Apache 2.0 licensing for those changes.

You don't need LinkedIn to sign anything for you to be able to include it in your project. Should their project merge into your project then it would make sense to get ICLAs signed and/or a software grant.

> Dear Legal team,
> There's a subproject of Hadoop called Submarine (source code: https://github.com/apache/hadoop/tree/trunk/hadoop-submarine). Submarine depends on an open-source project called TonY (from LinkedIn): https://github.com/linkedin/TonY
> The license of TonY is BSD-2 Clause license.
> My questions:
> 1) For TonY, can we (Hadoop committers) safely fork and embed source code of TonY in our codebase? The reason is, we want to fast iterate projects, going through PR, wait for a release will slow down our development.
> 2) Is there any prerequisite to include source code of TonY? For example, do we need to get an agreement from LinkedIn https://www.apache.org/licenses/contributor-agreements.html#grants
> Hope to hear back from you soon.
> Thanks,
> Wangda
