[jira] [Created] (LEGAL-126) Can code from a 3rd party be included in an Apache project when it is available under 2 licenses, one which is compatible with the ASL and one that is not?

Can code from a 3rd party be included in an Apache project when it is available under 2 licenses, one which is compatible with the ASL and one that is not?
-----------------------------------------------------------------------------------------------------------------------------------------------------------

                 Key: LEGAL-126
                 URL: https://issues.apache.org/jira/browse/LEGAL-126
             Project: Legal Discuss
          Issue Type: Question
            Reporter: Gabe Resneck

I would like to add some code to the OODT project, however this code is heavily dependent upon the jQuery library (http://jquery.com/). JQuery is available under both the MIT and GPLv2 licenses (http://jquery.org/license/). While it would seem from documentation available to committers that the MIT license is compatible with the ASL (http://apache.org/legal/resolved.html#category-a), I have been advised that GPLv2 is not. Do both licenses have to satisfy the ASL, or does simply satisfying one of the two licenses (in this case, the MIT license) make the code acceptable to submit?

Since JQuery is available under your choice of license, simply chose the one that best serves your purposes and ignore the other.

Thanks, everyone, for the clarification. Kevan, thanks for the link. I saw that when poking around for an answer. Unfortunately, understanding licenses is not my forte, so I thought it best to seek confirmation.
Thanks again!

AIUI, the choice of license needs to be documented in the LICENSE file.
Also in the NOTICE file if the license conditions require an entry in the NOTICE file.
