There are a lot of acronyms in this issue which I'm not an expert on. Is this a question about whether Derby falls afoul of U.S. export control restrictions? I am not aware that Derby contains any code which is subject to export control restrictions. Derby does use encryption packages supplied by the underlying VM but I believe that the export controls apply to the VM and not to Derby.
If I have misunderstood the question, could you please explain your acronyms and provide more background about what information you need?

DERBY-1986 links to the legal-discuss thread that was relevant at the time. That was a hot topic back then. If you search legal-discuss@apache.org for "crypto" or "TSU" you'll get lots of hits.
Most of that good info was added to http://www.apache.org/dev/crypto.html, which also outlines the steps that PMCs are to take (and does not include obtaining a Commodity Classification Request from the Department of Commerce).
If there are still questions after reading http://www.apache.org/dev/crypto.html page, feel free to post to legal-discuss@apache.org, which is monitored by the ASF Legal Affairs Committee (http://www.apache.org/legal).

Thanks for that clarification, Ann. I don't think that the Derby community can answer your question about Apache POI. Let's see whether anyone in this community remembers why ASF determined that 5D002 is the correct classification for Derby.
That determination might have been made during incubation. Does anyone remember whether export controls were discussed during incubation?

I apologize, Rick. Did ASF obtain a Commodity Classification Request from Dept. of Commerce for Derby and POI. Both are listed on http://www.apache.org/licenses/exports/ as Export Control Classification Number 5D002.
How was it determined that export license exception TSU (Technology/Software - Unrestricted) could be used for the ECCN 5D002?
This is a question for geared toward a legal department most likely.
