Tomcat 5 rejects <jsp:include ....></jsp:include>

I believe this has been raised at least once in the past, and the response was 
that you have to have a new line between the start and end jsp:include tags, 
i.e.
<jsp:include foo bar></jsp:include> is a no-no, but
<jsp:include foo bar>
</jsp:include>
is OK.  Try the latter and let us know.
