Thanks for raising this. I had concerns too.

I don't think there is an issue with distributing it. The issue is that it can't be AL2 since there are usage restrictions.

I would suggest (but have no authority here) that we make an exception and:
- we clearly mark the source file as non-AL2
- publish the binary along with the source to Maven central and our archives
- use it as an internal tool
- do not advertise it in the same way we advertise our normal downloads
- clearly state it isn't AL2 in any references we make to if (building instructions, POM files, etc.)
- ensure end-users have to do something to enable any download of the tool
