Closing as "Won't Fix".

HTML5 says it is allowed to use empty elements:
"The table, thead, tbody, tfoot, tr, ol, ul and dl elements are allowed to be empty in HTML."

If strict XHTML compliance is needed then a custom data table component should be used.
