More information:

Question: Why does the xerces.jar source build contain the jaxp classes in it, 
and why is the class files for DocumentBuilderFactory stored the META-INF of 
the normal jar.

Could this be causing the problem with the 1.4 JDK, as the JAXP classes are 
included in the rt.jar?

Please advice.
