as reported earlier we found additional showstopper that are critical
enough to prepare a further RC candidate and start a new vote.

I am not sure if it is really a showstopper it is broken since 4.0. Well
the related code is sub optimal to say it careful and the behaviour
changed indirectly because of other changes.
