After a fresh install of 1.3.22 with mod_ssl according to the recommended procedure, using this statement:
./configure --with-layout=Solaris --enable-rule=SHARED_CORE --enable-module=so --enable-module=rewrite --enable-shared=rewrite --enable-module=env --enable-shared=env --enable-module=log_config --enable-shared=log_config --enable-module=mime --enable-shared=mime --enable-module=info --enable-shared=info --enable-module=mime_magic --enable-shared=mime_magic --enable-module=setenvif --enable-shared=setenvif --enable-module=status --enable-shared=status --enable-module=vhost_alias --enable-shared=vhost_alias --enable-module=cgi --enable-shared=cgi --enable-module=ssl --enable-shared=ssl
for the apache build, it turns out that in apachectrl, i find this line:
[...]
PIDFILE=/usr/apache/logs/httpd.pid
[...]
while in httpd.conf it reads like this:
[...]
PidFile /var/run/httpd.pid
[...]
causing the following:
root@chaplin [/var/apache/logs]> /usr/apache/bin/apachectl stop
/usr/apache/bin/apachectl stop: httpd (no pid file) not running

Solved it by changing the PIDFILE assignment inside apachectrl to
PIDFILE=/var/run/httpd.pid
