Apache process Question

I am running apache 1.3.24 (without the patch) and have run across an
issue with a process.  When Apache is running I always have a process
similar to the one listed below:
root      2016  2007  0 23:12 ?        00:00:00 [sh <defunct>]
 
The process ID is constantly changes.  When I stop apache, this process
disappears.
 
Can someone verify that upgrading to 1.3.26 and/or patching will resolve
this?  Is this something that should be reported as a bug?
