You are absolutely correct :-) I added a bug/patch to bugzilla: 
http://nagoya.apache.org/bugzilla/show_bug.cgi?id=19508.

Cocoon 1 is no longer maintained, but at least Cocoon 2.0 and 2.1 shell 
be fixed.
