We have the same Problem, Ant 1.6.5, JUnit 3.8.2, JDK 1.4.2_12. When I exclude
the xalan.jar from the path, it works. Like this:

<path id="myclasspath">
	<fileset dir="${dir.lib}">
		<include name="*.jar"/>
		<exclude name="xalan.jar"/>
	</fileset>
</path>
