If you download and install TomEE, the logs directory is not empty. catalina.out already has some content. This directory should be empty.

i tried http://mirror.speednetwork.de/apache//openejb/4.0.0-beta-1/apache-tomee-1.0.0-beta-1-webprofile.tar.gz (first link on the page you gave) and logs directory is empty (as in the release/snapshot repository)...

can you give us the direct link to the tar you downloaded please?

did you have the issue on the 1.0.0-beta-2-SNAPSHOT? i just unzip it and it is empty

I did not try that. I downloaded TomEE from here:- http://www.apache.org/dyn/closer.cgi/openejb/4.0.0-beta-1/apache-tomee-1.0.0-beta-1-webprofile.tar.gz 
After I extract the files, I did not find the logs directory empty.
