problem adding document: document malformed

when i try to add the following document xindice gives
'document malformed' error

<DATA >
 <DATAELEMENT EVENTTIME="36:07" rdf:about="123456">
   <CONTENT>abcef</CONTENT>
 </DATAELEMENT>
</DATA>

the funny thing is when i add it to my laptop it works
without problem ..

both have the same program and the same jar files...
what can be the problem??
