"The prefix xml is by definition bound to the namespace name
http://www.w3.org/XML/1998/namespace. It may, but need not, be declared, and
must not be bound to any other namespace name. No other prefix may be bound to
this namespace name."

I believe similar language exists in the DOM spec, but I'll let you look that up 
for yourself.

If it hurts when you do that, and the spec says you can't do that, don't do that 
-- use the correct prefix (xml:) for this reserved namespace, and don't try to 
use this namespace URI for other purposes.
