Note that trademarks are about ensuring relevant users are not confused as to the origin of the trademarked goods (product, service, etc.).  So it's critical to understand for any of the pre-existing uses or registrations what kind of software product they are, to consider if users of one organization's "Rat" software could be confused by seeing the other organization's marketing materials, website, etc.

Robert, that's an excellent "kill search"! Thanks for doing it so thoroughly.

It sure seems like there are lots of rats out there that could be found by casual users instead of Apache Rat. Is that the environment that the Apache Rat project wants to find itself in? Standing out among such a set of creatures requires extensive marketing.

Your posted question is whether RAT is a "suitable name". That sort of depends on how famous *our* rat will be among all the other rodents in the software world when people search for us online.

P.S. My personal reaction: If I weren't an Apache Rat project member somehow enamored of the name "rat", and if I were interested in achieving commercial success for a famous software product, I'd pick something different as my name.

The consensus reached is that though Apache Rat is a suitable name for an product, a good top level project would be more unique name. 

After discussions with the wider incubator community, the Rat community aspires to become a home for a suite of related products developed in any language. The community prefers to retain Rat as the name for the original product and adopt more unique top level project name after graduation.

The following remark might belong on trademarks@. Not all Apache projects have the ambition of making a showy name for themselves in the marketplace of ideas. This one, I suspect, particularly not. Does Foundation policy require a defensible trademark, or merely avoiding infringement of someone else's?

Benson asked a policy question which might require thought on trademarks@.  My unofficial thought is: Apache projects must choose names that are not likely to be infringing on other existing marks, when taking into account that we always use a primary branding of Apache Foo, and the fact that we are a non-profit that provides software for the public good.

So from a policy perspective, I'm thinking the ASF will insist that it's projects not choose names that would infringe on other organization's names (or other Apache projects).  Defensibility is something that we need to ensure we inform the project about, but the final decision for choosing the name is up to the project.

If the Apache Rat podling is scurrying hard to keep the name, they should choose it.  If they want something that will ensure only they can eat their unique cheese, they should consider a more unique name.  But it's up to the podling to choose.
