The CVS diff you posted shows changes in one source file, in the actual
commit for Tomcat 5 changes related to this were made to a number of
other files.

Reviewing some of the relevant code comments shows that what you are asking to
be removed was implemented to comply with the Servlet 2.3 spec. Tomcat 5
is implmenting the Servlet 2.4 spec.

You state that the code for doing this is broken, how is it broken?

If it is required by the spec shouldn't it be fixed rather than removed?
