IP Clearance for the NMS tibco contribution

Howdy folks,

Just an FYI.. but I've started a ip-clearance document for the
excellent NMS contribution that Jim Gomes is donating.

One of the questions it ask is "If applicable, make sure that any
associated name does not
                already exist and is not already trademarked for an
existing software
                product"

Well obviously part of the module name is Tibco and that's
trademarked name.  You guys this is a problem??  Should we run this by
legal?
