In 1999 schema, xsi:nil shouldn't make any sense (Tom J is correct).  
Therefore, Axis is doing basically the right thing by ignoring the attribute.  
If you change it to xsi:null instead of switching schema versions, we should do 
OK with it too.  Closing this bug.
