copy21 testcases fails in trax.dom flavor

When I run the test harness against the conformance test bucket using the 
trax.dom flavor, the copy21 testcase is flagged as a failure.   

This is reproducible on the Xalan Java 2.4.1 release and current cvs but 
appears to pass when Xalan Java 2.4.0 is used.
