The attribute in question is omit-xml-declaration, which is defaulted to 'no'
for JSP documents without a jsp:root.  That double negative means xml
declaration should exists, right?  :-)

I do agree with you that it makes more sense to NOT generate an XML declaration
if there is no jsp:root.  But with the current spec, this is not a bug.
