[Bug 120119] empty heading not included in contents index (ToC)

I can reproduce the defect

below is my reproducing step:
1.launch oo and new a text document
2.input "Chapter 21" and apply it heading 1 by tools->outline numbering
3.insert TOC by "Insert->Indexed and Tables"

defect:
the chapter 21 is not inserted in the TOC.

Note:
apply "chapter 21" level 1 by context menu->paragraph->Outline&Numbering,it
will be inserted in the TOC.
