Maven's jira is still at codehaus, and this submitted just left a trail of breadcrumbs pointing to a patch at github. Can I take it, or do I need to get the submitter to do something positive to submit it?

Here's the relevant portion of the Apache License:

"Contribution" shall mean any work of authorship, including the original version of the Work and any modifications or additions to that Work or Derivative Works thereof, that is intentionally submitted to Licensor for inclusion in the Work by the copyright owner or by an individual or Legal Entity authorized to submit on behalf of the copyright owner. This would make the relevant question to be: is Maven's jira managed by, or on behalf of, the ASF?

Sam,

Can I just check that you spotted the nuance in this issue (coincidentally a similar question has been asked in the JENA podling).

The issue might not be just one of where JIRA is hosted, but also whether the contribution has actually been submitted.

In this case someone has provided a link to some code which they claim to have the right to submit (i.e. they have checked the license grant box). They have not uploaded a patch to JIRA. Does this still count as submission?

(in the case of JENA it is a little simpler as the issue is on ASF JIRA).

I would argue that the maven jira projects at codehaus are managed by codehaus on behalf of the ASF Maven TLP. Does that seem reasonable?

The relevant questions are: do you believe that it was authored by this individual and was intentionally submitted?

In this specific case, I see a 5 line patch provided by somebody who authored it themselves and by someone that has been involved with the community for a number of years

The only thing that would make me feel more confident is an ICLA on file.  Given that we are talking about 5 lines I see no need for such in this instance.
