This bug is a duplicate of bug #8864. And has been fixed in CVS.

The recently published namespace errata requires that all namespace declaration 
attributes to be bound to the namespace "http://www.w3.org/2000/xmlns/".

Now "NS" and "xmlns:NS" belong to different namespaces, and the error about
duplicate attributes won't be thrown.
