Out of what being requested here "Read access to code, discussions, issues, members, metadata, and pull requests" pretty much everything but members and metadata are publicly available anyway. So I don't see an issue with that.
On members and metadata somebody much more familiar with GitHub (INFRA perhaps?) needs to educate Legal Committee on what exactly GitHub is going to disclose.
