I cannot reproduce the issue. Following are my steps:

1. Setup a basic zone with dynamic.scale.vm = false
2. Create a new domain and a user
3. Login with newly created user
4. Add a new instance and navigate to its detail view
5. Click on "scaleUp VM" button

Could you please provide screenshot and more detail,
