Exception when placing resources.xml in apps

Following the advice here http://tomee.apache.org/tomee-directory-structure.html I placed a resources.xml file into the apps directory. When starting up with this configuration TomEE throws an exception. The same resources.xml file causes no issues when placed inside a webapp so I don't believe the resources.xml format to be an issue. Reporting to list as stack asked :)

You can deploy a resources.xml alone and thats useful...but you need to
know what you deeply, thats more for frameworks than end users IMO

Well if it is not recommended then it is not worth the trouble of getting this working anyway. I was just doing a quick definition with it to test something and the exception came up.
