Hum, it's because the check for "Empty partition" is invalid...
With the current code, it's possible for the first inserted row/partition to be empty (due to https://github.com/apache/cassandra/blob/cassandra-2.1/src/java/org/apache/cassandra/io/sstable/SSTableSimpleUnsortedWriter.java#L177 )
That's why the check allows for the first row/partition to be empty (https://github.com/apache/cassandra/blob/cassandra-2.1/src/java/org/apache/cassandra/io/sstable/SSTableSimpleUnsortedWriter.java#L233)

BUT the buffer is a TreeMap which reorders keys (thus the first inserted key is not necessarily in the first position/the first returned by the iterator).
