Linotype licence

I am customising the Linotye sample block. It now looks nothing like it but
still using 80% of the code. Can I offered this as a content management
solution to a client?

The info at http://www.apache.org/foundation/licence-FAQ.html seems to give
the thumbs up but http://creativecommons.org/licenses/by-nc-sa/1.0/ which is
also noted says:

"Noncommercial. You may not use this work for commercial purposes"
Whilst also saying.
"Any of these conditions can be waived if you get permission from the
copyright holder. "


So, can I get permission to use this as a CMS system for clients websites?
