Validating instance doc w/o XSD causes error

While testing my earlier changes, I noticed that validating an instance
doc that is not associated w/ an XSD causes an error.  I think at least
some developers decided that this was incorrect behavior based on the
XML Schema spec.  Is someone planning to fix this?
