In general, I'm happy for projects to decide what they want PRODUCT NAME to be, whether a top level project name or a product brand. However, AIUI trademarks are gained and maintained through commerce. So, perhaps there may be some implications for a project who wishes to protect using trademarks the good name of a product if they choose to use the top level project name. But IANAL.
