+1 to fail; one can call DELETESHARD.   And DELETESHARD may stop you as well (e.g. not using ImplicitRouter and this isn't an inactive pre-split shard).

FYI I discovered this reading about [~jwartes] cool https://github.com/whitepages/solrcloud_manager that adds some safety at the client end to working with SolrCloud.
