[Bug 56037] In non-GUI mode test run gets incorrectly set to failure
resulting in sending failure email providing test fragment is used

I am not sure to fully understand bug report as Test Plan is complex.

So what seems strange to you seems regular according to documentation.
Could you attach JMeter log file for non-gui and gui runs ?
Also if you can create a simple test plan using Debug Sampler and Java Request
it would be much easier to analyze.
