[Bug 56037] In non-GUI mode test run gets incorrectly set to failure resulting in sending failure email providing test fragment is used

Hello,
I am not sure to fully understand bug report as Test Plan is complex.

previously reaching the failure limit , a success email is sent. The mailer
will thus only send out messages in a sequence of
failed-succeeded-failed-succeeded, etc. ' 
So what seems strange to you seems regular according to documentation.

Could you attach JMeter log file for non-gui and gui runs ?
Also if you can create a simple test plan using Debug Sampler and Java Request
it would be much easier to analyze.
