Resolution: Fixed
I adjusted the loop control for peek so it is now:
while (m_pParser->parseNext(m_ScanToken) && AXIS_FAIL != m_Xhandler.getStatus())
Code is now in SVN.
Will wait on closing to see if we can come up with a test case and to hear of any problems from people.
