I agree with Matthieu.

distributing only the binary with a prominent notice is not controversial; what is controversial is the expulsion of code that does not meet this criteria.

In the 3rd party policy (draft), CPL is category B. So it should be okay as long as the usual precautions are taken (only binary distributed, prominent notice).
