In reference to http://www.apache.org/legal/release-policy.html#publication and http://www.apache.org/legal/release-policy.html#host-rc give conflicting information and it seems that this "no advertising" rule has caused many projects to instead count on vendors to offer nightlies to the community.
I think that #publication should be rewritten to make it clear where developer information can be found in the same way as how to find the source code repository.
To publication I would add an additional paragraph like:
"The project website may have a separate webpage distinct from the download page where interested developers can find information about the development community including the location of repositories, ci, and nightly builds. There should be a disclaimer that anyone who uses a nightly build takes the risk that there are potential technical and legal risks."
