Looks like I have problems with the same bug. I used the following
rewrite on apache 1.3:

RewriteCond %{HTTP_ACCEPT} application/xhtml\+xml
RewriteCond %{REQUEST_URI} \.html$
RewriteCond %{THE_REQUEST} HTTP/1\.1
RewriteRule .* - "[T=application/xhtml+xml; charset=iso-8859-1]"

this should change the mediatype of .html-files to application/xhtml+xml
if browser says that it supports application/xhtml+xml. This rewrite
worked just fine on apache 1.3 but now on apache 2.0.50 I have
problems with indexes.

If I request for:

http://appro.mit.jyu.fi/2004/syksy/www/

I get text/html

but if I try:

http://appro.mit.jyu.fi/2004/syksy/www/index.html

I get application/xhtml+xml

This looks like a real bug.
