Ok, you are right,
If I include the line
Lucene.Net.Search.BooleanQuery.SetMaxClauseCount(Int32.MaxValue);
The exception Isn’t throws, and the problem must be that the method isn’t trhows a BooleanQuery.TooManyClauses exception
Is a bug?

No, this is not a bug. It's a memory trade off feature of Lucene.
