As I told you when you posted to the newsgroup, this is by design.

It is documented that .htaccess is ignored only when AllowOverride is set to
none.  It is not explictly documented that putting a non-overridable directive
in there will get you an Internal Server Error, but that behavior is consistent
with Apache's directive handling in other situations.
